The Queen's College, Oxford, UK In his article `Facts and Principles', G.A. Cohen attempts to refute constructivist approaches to justification by showing that, contrary to what their proponents claim, fundamental normative principles are fact- in sensitive. We argue that Cohen's `fact-insensitivity thesis' does not provide a successful refutation of constructivism because it pertains to an area of meta-ethics which differs from the one tackled by constructivists. While Cohen's thesis concerns the logical structure of normative principles, constructivists ask how normative principles (...) should be justified . In particular, their claim that justified fundamental normative principles are fact-sensitive follows from a commitment to agnosticism about the existence of objective moral facts. We therefore conclude that, in order to refute constructivism, Cohen would have to address questions of justification, and take a stand on those long-standing meta-ethical debates about the ontological status of moral notions (for example, realism versus anti-realism) with respect to which he himself wants to remain agnostic. Reference to the state is ubiquitous in debates about global justice. Some authors see the state as central to the justification of principles of justice, and thereby reject their extension to the international realm. Others emphasize its role in the implementation of those principles. This chapter scrutinizes the variety of ways in which the state figures in the global-justice debate. Our discussion suggests that, although the state should have a prominent role in theorizing about global justice, contrary to what is (...) commonly thought, acknowledging this role does not lead to anti-cosmopolitan conclusions, but to the defense of an “intermediate” position about global justice. From a justificatory perspective, we argue, the state remains a key locus for the application of egalitarian principles of justice, but is not the only one. From the perspective of implementation, we suggest that state institutions are increasingly fragile in a heavily interdependent world, and need to be supplemented—though not supplanted—with supranational authorities. Background Cancer patients are at risk of developing blood clots in their veins - venous thromboembolism - which often takes the form of a pulmonary embolism or deep vein thrombosis. The risk increases with advanced disease. Evidence based treatment is low molecular weight heparin by daily subcutaneous injection. The aim of this research is to explore the barriers for doctors in the UK when diagnosing and treating advanced cancer patients with VTE. Method Qualitative, in-depth interview study with 45 doctors. Doctors (...) were from three specialties: oncology, palliative medicine and general practice, with a mixture of senior and junior staff. Framework analysis was used. Results Doctors opinions as to whether LMWH treatment was ethically appropriate for patients who were symptomatic from VTE but at end of life existed on a shifting continuum, largely influenced by patient prognosis. A lack of immediate benefit coupled with the discomfort of a daily injection had influenced some doctors not to prescribe LMWH. The point at which LMWH injections should be stopped in patients at the end of life was ambiguous_._ Some perceived ‘overcaution’ in their own and other clinicians’ treatment of patients_._ Viewpoints were divergent on whether dying of a PE was considered a “good way to go”. The interventionalism and ethos of palliative medicine was discussed. Conclusions Decisions are difficult for doctors to make regarding LMWH treatment for advanced cancer patients with VTE. In this paper we focus on the psychiatric approach of Open Dialogue and seek to explain why the intersubjective process of dialogue, one of OD’s core clinical principles, is effective in schizophrenia treatment. We address this question from an interdisciplinary viewpoint, by linking the OD approach with a theoretical account of the self as endorsed by enactive cognitive science. The paper is structured as follows: first, we introduce the OD approach and focus in particular on the principles that are characteristic (...) of the dialogical therapeutic attitude. Second, we clarify our stance on the concept of schizophrenia by relying on insights from phenomenological psychiatry. Third, we introduce an enactive perspective on mental disorders, which elaborates on phenomenological psychiatry and conceives of the self as a self-organizing system, brought forth through interactional processes. Based on this enactive approach, we draw clinical implications for schizophrenia. In the fourth and final part, we propose conceptual bridges between the OD and the enactive approach by bringing to attention the intersubjective nature of the human self and the inherent vulnerability entailed in both the self’s maintenance and in the practice of dialogue. We then propose that the dialogical stance adopted by OD is effective in supporting the recovery of a balanced sense of self precisely because it provides an intersubjective space in which clients can safely experience and maintain the basic structures underlying the socially constituted self. Since our analysis touches upon fundamental structures of the therapeutic relationship, we hope that it will also be useful to inform general psychiatric practice and help advancing a more integrative understanding of psychotherapy for schizophrenia. The primary purpose of the current research was to examine the psychometric properties of the Time Flow Mindfulness Questionnaire, a new self-report scale designed to measure cognitive, emotional, bodily, context-related, and action-related distracting inputs experienced by the mind during three different time windows of mindfulness practice. The 42-item scale assesses the following second-order and first-order factors: Practice, Benefits and Benefits at work. Three studies were conducted. The first study assessed the factor structure and internal consistency on a sample of 141 (...) mindfulness practitioners. Using a two-wave lagged design on a different sample of 46 trainees attending mindfulness based stress reduction courses, the second study examined concurrent validity by performing correlations between the TFMQ and Five Facets Mindfulness Questionnaire. The third study examined criterion validity by testing a structural equation model wherein mindfulness practice predicts job burnout, both directly and indirectly through mindfulness benefits at work. All studies relied on anonymous surveys. Our findings suggest that the TFMQ: has a factor structure consistent with the hypothesized conceptual dimensions; has good concurrent validity as demonstrated by significant correlations with the FFMQ dimensions; and consists of mindfulness dimensions that predict job burnout in organizations. The TFMQ is a valid and reliable mindfulness measure that may help practitioners gain awareness of different types of inputs that potentially distract the mind and mindfulness beneficial consequences, and organizations implement mindfulness in work-settings. The literature addressing bias and fairness in AI models (fair-AI) is growing at a fast pace, making it difficult for novel researchers and practitioners to have a bird’s-eye view picture of the field. In particular, many policy initiatives, standards, and best practices in fair-AI have been proposed for setting principles, procedures, and knowledge bases to guide and operationalize the management of bias and fairness. The first objective of this paper is to concisely survey the state-of-the-art of fair-AI methods and resources, (...) and the main policies on bias in AI, with the aim of providing such a bird’s-eye guidance for both researchers and practitioners. The second objective of the paper is to contribute to the policy advice and best practices state-of-the-art by leveraging from the results of the NoBIAS research project. We present and discuss a few relevant topics organized around the NoBIAS architecture, which is made up of a Legal Layer, focusing on the European Union context, and a Bias Management Layer, focusing on understanding, mitigating, and accounting for bias. Through examination of a case study of Liberian refugee participation in the Truth and Reconciliation Commission of Liberia, this article highlights concerns about the lack of opportunity for refugee participation in peacebuilding generally. The experience of the authors working with refugees in the Buduburam Settlement near Accra, Ghana, demonstrates the overwhelming desire of refugees to participate in the processes that directly impact their lives, as well as the future of their home and host countries. The article concludes with the suggestion (...) that the Liberian Truth and Reconciliation Commission’s work with refugees can serve as a model of how refugee participation can be enhanced in similar processes in the future. A recurring concern within contemporary philosophy of language has been with the ways in which speakers can be illocutionarily silenced, i.e. hindered in their capacity to do things with words. Moving beyond the traditional conception of silencing as uptake failure, Mary Kate McGowan has recently claimed that silencing may also involve other forms of recognition failure. In this paper I first offer a supportive elaboration of McGowan’s claims by developing a social account of speech act performance, according to which the (...) success of an illocutionary act is not only a function of the intentions of and the conventions deployed by the speaker, but partly depends on how the act is recognized or taken up by the hearer. I then provide a comprehensive definition of illocutionary silencing and spell out what it means for it to occur in a systematic manner. (shrink)

When and why do socially constructed norms—including the laws of the land, norms of etiquette, and informal customs—generate moral obligations? I argue that the answer lies in the duty to respect others, specifically to give them what I call “agency respect.” This is the kind of respect that people are owed in light of how they exercise their agency. My central thesis is this: To the extent that (i) existing norms are underpinned by people’s commitments as agents and (ii) they (...) do not conflict with morality, they place moral demands on us on agency-respect grounds. This view of the moral force of socially constructed norms, I suggest, is superior to views that deny the moral force of such norms, and it elegantly explains certain instances of wrongdoing that would otherwise remain unaccounted for. In recent years, business ethics and economic scholars have been paying greater attention to the development of commons organizing. The latter refers to the processes by which communities of people work in common in the pursuit of the common good. In turn, this promotes commons organizational designs based on collective forms of common goods production, distribution, management and ownership. In this paper, we build on two main literature streams: the ethical approach based on the theory of the common good of (...) the firm in virtue ethics and the economic approach based on the theory of institutions for collective action developed by Ostrom’s research on common-pool resources to avert the tragedy of the commons. The latter expands to include the novel concepts of new commons, “commoning” and polycentric governance. Drawing on the analysis of what is new in these forms of organizing, we propose a comprehensive model, highlighting the integration of two sets of organizing principles—common good and collective action – and five problem-solving processes to explain the main dimensions of commons organizing. We contribute to business ethics literature by exploring the convergence between the ethical and economic approaches in the development of a commons organizing view. (shrink)

Trust is a core feature of the physician-patient relationship, and risk is central to trust. Patients take risks when they trust their providers to care for them effectively and appropriately. Not all patients take these risks: some medical relationships are marked by mistrust and suspicion. Empirical evidence suggests that some patients and families of color in the United States may be more likely to mistrust their providers and to be suspicious of specific medical practices and institutions. Given both historical and (...) ongoing oppression and injustice in American medical institutions, such mistrust can be apt. Yet it can also frustrate patient care, leading to family and provider distress. In this paper, I propose one way that providers might work to reestablish trust by taking risks in signaling their own trustworthiness. This interpersonal step is not meant to replace efforts to remedy systemic injustice, but is an immediate measure for addressing mistrust in occurrent cases. (shrink)

This paper proposes a new relational account of concepts and shows how it is particularly well suited to characterizing normative concepts. The key advantage of our ‘connectedness’ model is that it explains how subjects can share the same normative concepts despite radical divergences in the descriptive or motivational commitments they associate with them. The connectedness model builds social and historical facts into the foundations of concept identity. This aspect of the model, we suggest, reshapes normative epistemology and provides new resources (...) for a vindication of realism in ethics. (shrink)

This paper articulates two constraints on an acceptable account of meaning: (i) accessibility: sameness of meaning affords an immediate appearance of de jure co-reference, (ii) flexibility: sameness of meaning tolerates open-ended variation in speakers' substantive understanding of the reference. Traditional accounts of meaning have trouble simultaneously satisfying both constraints. I suggest that relationally individuated meanings provide a promising way of avoiding this tension. On relational accounts, we bootstrap our way to de jure co-reference: the subjective appearance of de jure co-reference (...) helps make it the case that two token representations really do co-refer. The research presented in this paper focuses on business ethical values inChina, a country in which the process of institutional transformation has left cultural values in a state of flux. A survey was conducted in China and the U.S. by using five business scenarios. Survey results show similarities between the Chinese and American decision choices for three out of five scenarios. However, the results reveal significant differences in rationales, even forsimilar decisions. Patient and citizen participation is now regarded as central to the promotion of sustainable health and health care. Involvement efforts create and encounter many diverse ethical challenges that have the potential to enhance or undermine their success. This article examines different expressions of patient and citizen participation and the support health ethics offers. It is contended that despite its prominence and the link between patient empowerment and autonomy, traditional bioethics is insufficient to guide participation efforts. In addition, the turn to (...) a “social paradigm” of ethics in examinations of biotechnologies and public health does not provide an account of values that is commensurable with the pervasive autonomy paradigm. This exacerbates rather than eases tensions for patients and citizens endeavoring to engage with health. Citizen and patient participation must have a significant influence on the way we do health ethics if its potential is to be fulfilled. (shrink)

Do we mentally simulate olfactory information? We investigated mental simulation of odors and sounds in two experiments. Participants retained a word while they smelled an odor or heard a sound, then rated odor/sound intensity and recalled the word. Later odor/sound recognition was also tested, and pleasantness and familiarity judgments were collected. Word recall was slower when the sound and sound-word mismatched. Sound recognition was higher when sounds were paired with a match or near-match word. This indicates sound-words are mentally simulated. (...) However, using the same paradigm no memory effects were observed for odor. Instead it appears odor-words only affect lexical-semantic representations, demonstrated by higher ratings of odor intensity and pleasantness when an odor was paired with a match or near-match word. These results suggest fundamental differences in how odor and sound-words are represented. (shrink)

In this paper I discuss the reasons for which we may consider wonder an epistemic emotion. I defend the thesis for which a specific type of wonder is aporia-based and that since it is aporia-based, this wonder is epistemic. The epistemic wonder is thus an interrogating wonder which plays the epistemic function of motivation to questioning in processes of inquiry. I first introduce the contemporary debate on epistemic emotions, and then I analyze the characteristics that make of wonder an epistemic (...) emotion, from a data-based, phenomenological, and conceptual perspective. In “Against alief”, Mandelbaum :197–211, 2013) argues that if aliefs—a sui generis kind of mental states originally posited by Gendler :634–663, 2008a; Mind Lang 23:552–585, 2008b; Analysis 72:799–811, 2012)—are to play the explanatory role that is usually ascribed to them, their contents must be propositionally structured. However, he contends, if aliefs have propositional contents, it is unclear what distinguishes them from beliefs. I find Mandelbaum’s arguments in favour of the idea that aliefs must have propositional contents to be compelling. However, (...) I think aliefs should only be credited with a deflated kind of propositional content that I will baptize as “semi-structured propositional contents”, since they are composed by representational units that are neither fully un-detachable nor fully re-combinable. As I will argue, this way of understanding the content of aliefs not only allows us to accommodate all the worries raised by Mandelbaum regarding the nature of their contents, but it also it helps explain why aliefs have some of the peculiar features that Gendler ascribes to them. Consequently, it gives to the advocates of aliefs new tools to defend, against Mandelbaum, that these are sui generis mental states with their distinctive functional role in our cognitive lives. In this text, Georges Didi-Huberman responds, in letter-form, to the critical reflections about his work formulated by Jacques Rancière in “Images Re-read: Georges Didi-Huberman’s Method.” Didi-Huberman disagrees with Rancière’s analysis that images are “passive” and that the words which accompany them are “active.” Instead, he agrees with Merleau-Ponty’s view, which postulates that any analysis of images that seeks to disentangle its elements will render the image unintelligible. In opposition to Rancière’s presentation of his work, Didi-Huberman argues that his method is (...) one of tracing the mutually entangled implications of images. Furthermore, Didi-Huberman challenges Rancière to articulate what exactly “the sensible” means when he uses the phrase “distribution of the sensible.” While Rancière distrusts the reliance on pathos and emotions when it comes to analysing images, Didi-Huberman argues that “the sensible” will always involve the body with all its pathos, emotions and gestures. Olfaction has recently been highlighted as a sense poorly connected with language. Odor is difficult to verbalize, and it has few qualities that afford mimicry by vision or sound. At the same time, emotion is thought to be the most salient dimension of an odor, and it could therefore be an olfactory dimension more easily communicated. We investigated whether sounds imitative of an innate disgust response can be associated with unpleasant odors. In two experiments, participants were asked to make a (...) forced choice between a pseudoword including a disgust sound and a neutral pseudoword, for pleasant and unpleasant odors. Overall, participants chose more disgust pseudowords than neutral pseudowords for unpleasant odors, but this was not the case for pleasant odors. This effect was not driven by a general association between unpleasant sounds and unpleasant odors, but specifically the sounds [x/χ] and [f], thought to reflect physical responses to disgusting odors, as seen in the Polish fu! or the English ugh!. In line with growing evidence that language can encode odor, we provide the first experimental evidence for an association between the sound of a word and odor valence. (shrink)

The aim of this article is to contribute to understanding the changing role of government in promoting corporate social responsibility (CSR). Over the last decade, governments have joined other stakeholders in assuming a relevant role as drivers of CSR, working together with intergovernmental organizations and recognizing that public policies are key in encouraging a greater sense of CSR. This paper focuses on the analysis of the new strategies adopted by governments in order to promote, and encourage businesses to adopt, CSR (...) values and strategies. The research is based on the analysis of an explanatory framework, related to the development of a relational analytical framework, which tries to analyze the vision, values, strategies and roles adopted by governments, and the integration of new partnerships that governments establish in the CSR area with the private sector and social organizations. The research compares CSR initiatives and public policies in three European countries: Italy, Norway and the United Kingdom, and focuses on governmental drivers and responses. The preliminary results demonstrate that governments are incorporating a common statement and discourse on CSR, working in partnership with the private and social sectors. For governments, CSR implies the need to manage a complex set of relationships in order to develop a win–win situation between business and social organizations. However, the research also focuses on the differences between the three governments when applying CSR public policies. These divergences are based on the previous cultural and political framework, such as the welfare state typology, the organizational structures and the business and social and cultural background in each country. This paper examines whether realists can explain co-reference without appealing to subjects’ ideal convergence in judgment. This question is particularly pressing in the normative domain, since deep disagreement about the applicability of normative predicates suggests that different speakers may not pick out the same property when they use normative terms. Normative realists, we believe, have not been sufficiently aware of the difficulties involved in providing a theory of reference-determination. Our aim in this paper is to clarify the nature of this (...) reference-fixing task and the challenges that arise for a non-convergentist normative realist. Our focal point will be Richard Boyd’s externalist account, which has been a model for non-convergentist theories of reference in metaethics. A close examination of Boyd’s account of reference and the ways it could be developed or supplemented, we’ll argue, suggests that explaining co-reference without convergence in the normative domain is a more challenging problem than many realists have supposed. This paper sketches a right-maker account of normative practical reasons along functionalist lines. The approach is contrasted with other similar accounts, in particular John Broome's analysis of reasons as explanations of oughts.

In this article, I analyze norm enforcement on social media, specifically cases where an agent has committed a moral transgression online and is brought to account by an Internet mob with incongruously injurious results in their offline life. I argue that users problematically imagine that they are members of a particular kind of moral community where shaming behaviors are not only acceptable, but morally required to ‘take down’ those who appear to violate community norms. I then demonstrate the costs that (...) are associated with this strategy; the most worrisome being those that distort the nature of moral dialog and the purpose and effectiveness of accountability practices online, creating a vitriolic and polarising online environment. Because of these negative consequences, I suggest that we ought to hold others accountable for restorative ends. I argue that restorative accountability practices can help us cultivate new norms online that rely less for their enforcement upon negative acts such as shame, and more upon positive acts that focus upon the most appropriate way to make amends to the victim(s) and the community. In this sense, restorative accountability incorporates important elements from the ethics of care, a relational ethics that values creating, promoting, and restoring good social and personal relationships. I conclude by arguing that accountability practices premised on the ethics of care produce better outcomes for the victim (s) of a moral violation, the transgressor, and the community. (shrink)

En el presente trabajo nos proponemos reflexionar acerca de las posibilidades, límites y desafíos que se presentan en la práctica docente cuando jóvenes de sectores subalternos emprenden la tarea de escribir sus propias historias. Estas reflexiones surgen a partir de una experiencia pedagógica desarrollada en el marco del Programa Pueblos Originarios y Escuelas Rurales de la UNCuyo. Consideramos que la fragmentación y la discontinuidad es un rasgo de la memoria colectiva de los sectores subalternos, sin embargo, en ocasiones encuentra espacios (...) para expresarse y tensionar la historia oficial. En esa dirección, en esta ocasión, decidimos convertir nuestros espacios curriculares en ámbitos de reflexión personal y colectiva donde los y las subalternos (parafraseando a la filósofa india Gayatri Spivak) “pudieron hablar”, para luego plasmar sus historias en fanzines. Interactions with yellowjackets offer opportunities to reflect on what it is to encounter radical alterity and the conditions that are necessary for the limited empathy such encounters afford us. Effort must be made to set aside automatic judgments, and neither simulation nor theorizing can be sufficient to give us reliable insights, but mindful attentiveness can at least help us attend to the possibilities of interaction and tentative interpretation.
